Lawsuit Updates

The Board of Directors meets this Wednesday, February 18 at 6pm.

The following information was provided to me by concerned residents who are genuinely invested in the community’s well-being. Given the short time before tomorrow’s important meeting, I am providing this information as is, without further elaboration, until I have the opportunity and the time to thoroughly follow up on this pressing issue and gather more detailed insights.

Normally I would not post without investigating further, however both have indicated that their Facebook Post were censored.

PLEASE TAKE THE TIME TO ATTEND THIS IMPORTANT MEETING

Residents have submitted written requests to have the monetary assessments of up to $1,000.00 for each member noted in the annual meeting budget packet be on the agenda. (The $1,000.00 assessment does NOT include a lawsuit filed in Federal Court on January 2, 2026 and does not include money spent legal services since January 1, 2026.) Other requests for inclusion on the agenda include discussion on Section 7.1 of our By Laws that address insufficient budget funding and Section 3.1 which requires a governing Board of 9 elected members; we have a 10 Directors, one who was not elected and one that was elected but has no vote. A request has also been made or information from the Board on an investigation of NLYH by the Florida Commission on Human Relations for violations of the Florida Fair Housing Act. Details of the investigation are below.

The letter the Board sent to all members on January 20, 2026 did not mention that the NLYH had been under investigation by the Florida Commission on Human Relations (FCHR) for discriminatory housing practices. The investigation was launched in July 2025. A report on the investigation was issued on October 24, 2025  and the FCHR ruled that NLYH had violated the Fair Housing Act of 1968  and the Florida Fair Housing Act. As a result of this investigation a lawsuit was filed in Federal Court against NLYH on January 2, 2026.

The Board never informed residents of the investigation, the violations of laws by NLYH or the Federal lawsuit, only mentioning in the letter “three legal matters”, no details.

From Resident Two

Fellow Members, many have been aware and concerned with the amount of people that encountered enforcement of rules & bylaws through our lawyers. In the past two years there have been approximately 14 people pursued by legal means and now the backlash in Lawsuits. I asked on behalf of members how much was spent in the last 24 months on Lawyers. The board accommodated. The amount spent for years 2024 and 2025 is $222,622.56 against a member approved budget of $60,000. The park has lived on a $2000 a year legal budget most of its life. Many do not know what has went on because people have been muzzled before they can speak out about what has happened to them. It’s time for full disclosure on these expenditures and why we are using lawyers to enforce our rules.

In the meantime, I took the initiative to thoroughly investigate the situation and gather my own detailed information to better understand what is going on. I will work on compiling this information into a comprehensive format and sharing it with you as soon as possible, so you will be well-informed moving forward.

For everyone that missed the meeting or was there when my presentation was cut short. Here it is.
 
My Goal, to create a Membership Legal Team to oversee Lawyer usage against residents. It was asked to be on the agenda for member discussion tonight. It was declined.
My part in the conversation tonight concerns legal expenditures and the need for clarity in the written enforcement process to include a new member legal committee. That’s the stated solution to remedy the frequency of legal expenditures and action against residents. As a member-owned corporation, voicing opinions to effect change is essential. Our rules and bylaws are living documents that require review from time to time to ensure alignment with our community’s best interest. My resignation a year ago today was due to the many disagreements with our President and his over use of law-fare and attorneys to manage our rules and bylaws. Under President Espinolas leadership, legal costs have skyrocketed to $ 222,623 for 2024 and 2025. It exceeding the $60,000 budget approved by members. That’s $163,000 overspend. Historically, legal expenses at NLYH have been approximately $2,000-$10,000 annually. So, the solution I’ve recommended is a member legal committee, it could be a bylaw amendment or a written policy, but the committee would oversee and authorize any attorney usage against any NLYH member. This would eliminate any one individual or the executive board from usage of legal tactics for rule and bylaw enforcement. This would not tie the hands of our executive board in protecting us. Its the opposite, its protection of using legal means against residents by needing approval by this new committee. Lastly, because of my concerns as a board member last year and what I considered runaway legal spending and the entanglement in using our lawyers I legally requested these attorney expenditure details last month. Three days after I acquired these legal expenditures, on or about January 24th 2026 I was served with a Cease-and-Desist letter from our lawyers on this subject matter, this is not the first cease and desist letter served on a resident. These are generated by our leadership via our attorney’s at a cost to you the member. These aren’t cheap. I wasn’t OK with the spending a year ago while on the board. and I’m certainly not OK with it today. Its legal maneuvering that we don’t need. If this recommendation of a legal committee comes forward vote yes to put an end to another lawyer letter reaching someone else’s mailbox in NLYH.

"From what I understand, this is just one of several lawsuits that have been brought against our HOA. It seems that the issues at hand are not isolated incidents but rather part of a larger pattern. The information provided by Resident Two also includes alarming details regarding the costs incurred where our HOA has allegedly and maliciously targeted our residents, raising serious concerns about our community's management and operations."
